The Texas Supreme Court has raised the damages limit for expedited civil actions from $250,000 to $325,000. A Houston personal injury firm outlines what the change means for injured people deciding how to file a claim.
-- HOUSTON, TX, October 29, 2026 - The Texas Supreme Court has amended Texas Rules of Civil Procedure 47 and 169, raising the damages ceiling for “expedited actions” from $250,000 to $325,000. The final order, Misc. Docket No. 26-9079, took effect immediately. It followed a preliminary approval in May and a public comment period, and the Court made no changes to the proposed text.
Under Rule 169, the expedited process applies when every claimant, other than a counterclaimant, pleads that they seek only monetary relief of $325,000 or less. Interest, statutory or punitive damages, penalties, attorney fees and costs are excluded from that calculation. A party who proceeds under the rule cannot recover a judgment above the cap. Rule 47, which sets the damage categories stated in a petition, was updated to match. The Court said the amendments implement changes to section 22.004(h-1) of the Texas Government Code.
Expedited cases are designed to reach resolution faster and at lower cost, with streamlined discovery and shorter trials. A court may remove a case from the process for good cause. A claimant who later amends a petition to seek more than the cap generally needs the court’s permission.
Attorneys at Maida Law Firm, a Houston personal injury practice, say the change matters most for injured people deciding how to plead a claim.
The higher cap can speed up smaller cases, but a claimant who pleads under it is limited to that amount, so the full value of an injury claim should be understood before filing.]” said Sam A. Maida Jr., managing attorney of Maida Law Firm.
Serious injuries can produce claims well above the threshold. Harris County recorded 517 traffic deaths and 2,758 serious injuries in 2025, according to TxDOT figures reported by Axios Houston. Local news outlets reported several truck crashes on Houston freeways this month, including a fatal collision between a motorcycle and an 18-wheeler on the East Freeway on October 11 and an 18-wheeler rollover near North Post Oak on October 17. Investigators have not announced causes.
Attorneys at the firm advise that the value of an injury claim, including future medical care and lost income, be evaluated before a case is filed under the expedited process, because the cap limits recovery once that process is chosen.
