Ambrose Group Guide Explains When Texas Property Tax Arbitration Is Worth It

Oct 16, 2026

A new guide from The Ambrose Group walks Texas property owners through binding arbitration after an appraisal review board hearing, covering eligibility, the $450 to $1,550 deposit schedule, the 60-day filing window and how to judge whether arbitration is worth pursuing.

-- The Ambrose Group, a Texas property tax consulting, appraisal, and cost segregation firm, has published a guide to help property owners decide whether binding arbitration is worth pursuing after an appraisal review board (ARB) hearing. The guide at https://theambrosegroup.com/property-tax-arbitration-in-texas-is-it-worth-it/ was written by Executive Vice President Daniel Ambrose, MAI, and walks through the process from the ARB order to the final award.

Binding arbitration, created under Chapter 41A of the Texas Tax Code, gives owners a lower-cost alternative to a district court appeal when they disagree with the value an ARB sets. According to the guide, a residence homestead qualifies at any value, while other property qualifies when the ARB order value is $5 million or less. The protest must have concerned market value or unequal appraisal, taxes must be current, and the owner cannot have filed suit over the same property and tax year.

The guide lays out the deposit schedule set by statute, which ranges from $450 for a homestead valued at $500,000 or less to $1,550 for non-homestead property valued between $3 million and $5 million. The request must be filed with the Texas Comptroller within 60 days of receiving notice of the ARB order. If the arbitrator’s value lands closer to the owner’s stated opinion than to the ARB’s value, the deposit is refunded less a $50 administrative fee and the appraisal district pays the arbitrator. If not, the arbitrator’s fee comes out of the deposit, and the award is final.

The number an owner writes on the request form matters more than many expect. In the guide’s example, the ARB sets a commercial property at $2 million, the owner claims $1.5 million and the arbitrator lands at $1.8 million. The value drops by $200,000, yet the arbitrator’s fee still comes out of the deposit, because $1.8 million sits closer to the ARB figure. The guide also sets arbitration side by side with district court and the State Office of Administrative Hearings.

Ambrose puts the decision in plain terms. “Whether it’s worth it is arithmetic: realistic tax savings against the deposit at risk and the cost of preparing,” he writes. According to the guide, arbitration rarely pays off when the gap between the ARB value and a supportable number is small, or when the dispute is really a legal question that belongs in court. Refiling with the evidence the ARB already rejected is another trap. “A new decision-maker doesn’t change what the same evidence says,” Ambrose writes.

Timing matters this year. Section 23.231 of the Tax Code caps yearly appraisal increases at 20% for non-homestead real property valued at or under about $5.3 million, and the Texas Comptroller states that the cap expires December 31, 2026. Without an extension from lawmakers, 2027 notices on that property can reflect full market value, and larger increases usually lead to more cases that go beyond the ARB. Since September 1, 2025, certain lessees who reimburse an owner’s taxes can also request arbitration.

For owners weighing the next step, the guide describes the evidence that tends to decide commercial value disputes, including adjusted comparable sales, income and expense data, documented condition issues and independent appraisals. The page at https://theambrosegroup.com/property-tax-binding-arbitration-consultation/ describes the firm’s arbitration consultation service, and the page at https://theambrosegroup.com/appraisal-review-board/ covers representation at the earlier hearing stage.
